Please read these Terms of Service carefully before using Vizu.
- Interpretation and Definitions
1.1 Interpretation
Words with capitalized initials have meanings defined below. These definitions apply whether the terms appear in singular or plural form.
1.2 Definitions
For the purposes of these Terms of Service: • Account means a unique account created for You to access the Service or parts of the Service. • Athlete means a user who books or requests creative services through the Service. • Booking means a request for creative services made through the Service. • Company means Vizu Connect LLC, referred to as “Vizu,” “We,” “Us,” or “Our.” • Content means text, images, video, graphics, files, messages, portfolio materials, deliverables, reviews, or other information made available through the Service. • Creator means a user who offers creative services through the Service, including but not limited to photographers, videographers, and graphic designers. • Device means any device that can access the Service, including a computer, phone, or tablet. • Feedback means suggestions, comments, or ideas You provide about the Service. • Order or Booking means a request by an Athlete to book a Creator through the Service. • Service means the Vizu website, marketplace, application, and related services. • Terms means these Terms of Service. • Third-Party Services means services, software, payment providers, storage providers, verification providers, and other external tools used in connection with the Service. • Website means Vizu, accessible at vizuconnect.com. • You means the individual or legal entity accessing or using the Service.

- Acknowledgment
These Terms govern Your use of the Service and form a binding agreement between You and the Company.
By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, do not use the Service.
You represent that You are at least the age of majority in the jurisdiction where You reside, or otherwise legally able to enter binding contracts.
Your use of the Service is also subject to Our Privacy Policy.
- Nature of the Service
Vizu is an online marketplace that helps Athletes and Creators connect, communicate, book services, process payments, and manage creative projects.
Vizu is not the provider of the underlying creative services. Creators, not Vizu, are responsible for the services they offer, the content they produce, the accuracy of their listings, and the completion of their Bookings.
Vizu does not employ Creators unless expressly stated otherwise. Except where specifically stated, Vizu is not a party to the underlying service agreement between an Athlete and a Creator.
- User Accounts
5.1 Account Creation
When You create an Account, You must provide accurate, current, and complete information.
You may not create an Account using false information, impersonate another person, or use a username that is unlawful, misleading, or offensive.
5.2 Account Information and Verification
You may be required to provide information including Your name, email address, phone number, payment details, tax information, or identification documents.
Vizu may require identity verification, payment verification, or other screening before allowing You to use some or all features of the Service.
We may approve, deny, suspend, or remove Accounts at Our discretion for fraud prevention, safety, compliance, or policy enforcement reasons.
5.3 Account Security
You are responsible for safeguarding Your login credentials and for all activity under Your Account.
You must notify Us immediately of any unauthorized use of Your Account or security breach.
5.4 Account Termination
We may suspend or terminate Your Account at any time if You violate these Terms, present a safety risk, engage in fraudulent activity, or misuse the Service.
You may stop using the Service at any time. Terminating Your Account does not automatically cancel pending Bookings or remove obligations already incurred.
- Listings, Profiles, and Bookings
6.1 Creator Listings
Creators are responsible for their listings, rates, availability, portfolios, descriptions, turnaround times, and any other information they publish.
Creators must only list services they are legally permitted and professionally able to provide.
6.2 Athlete Responsibilities
Athletes are responsible for providing accurate Booking details, timely communication, required scheduling information, and any access needed for the Creator to perform the service.
6.3 Credentials, Access, and Venue Requirements
If credentials, media passes, restricted venue access, or other approvals are required for a Booking, the Athlete and Creator are responsible for coordinating those requirements in advance.
Vizu is not responsible for obtaining credentials, venue access, or third-party permissions for either party.
If access is not secured in time, the Booking may be impacted, delayed, or cancelled, and refunds or payouts will be handled according to these Terms and the applicable cancellation policy.
6.4 Booking Information
Both parties are responsible for reviewing all Booking details, including date, time, location, service scope, and delivery expectations, before confirming a Booking.
- Payments, Fees, and Payouts
7.1 Payments
Payments are processed through third-party payment providers. By using the Service, You agree to comply with the terms of those providers.
Vizu may collect payment from Athletes and facilitate payout to Creators in accordance with the Service’s payment flow.
7.2 Service Fees
Vizu may charge service fees, platform fees, booking fees, or similar charges. Applicable fees will be shown during checkout or otherwise disclosed through the Service.
We may change fees at any time for future Bookings.
7.3 Creator Payouts
Creator payouts may be delayed, held, reversed, or cancelled if required for fraud prevention, dispute resolution, chargebacks, policy violations, payment processor issues, or legal compliance.
Vizu does not guarantee that payouts will be instant or uninterrupted.
7.4 Taxes
Users are responsible for their own taxes, reporting obligations, and compliance with applicable law, unless otherwise required by law or explicitly handled by the Service.
- Delivery, Completion, and Confirmation
8.1 Creator Delivery Obligations
Creators are responsible for delivering the agreed creative work in the format, timeline, and scope described in the Booking or otherwise agreed in writing through the Service.
8.2 Athlete Confirmation
Athletes may be asked to confirm that final content has been received. If an Athlete confirms delivery, the Booking may be marked complete and the payout process may proceed.
8.3 Automatic Completion
Some Bookings may automatically move to completion after a set period under the marketplace workflow. By using the Service, You agree to the completion timeline and payment flow configured on the platform at the time of Booking.
8.4 Disputed Delivery
If an Athlete claims content was not received, incomplete, materially late, or materially different from what was agreed, the parties should attempt to resolve the issue directly first. Vizu may review the dispute and take action in its sole discretion, including delaying payout, cancelling a Booking, issuing a refund, or taking no action.
8.5 No Guarantee of Satisfaction
Because creative work is subjective, Vizu does not guarantee that an Athlete will be satisfied with artistic style, creative judgment, or subjective preferences unless there is a clear failure to provide the agreed service.
- Cancellations, Refunds, and No-Shows
9.1 General Rule
Cancellations, refunds, and no-show outcomes depend on the timing of the cancellation, the circumstances involved, the platform workflow, and any stated cancellation policy.
9.2 Athlete Cancellations
If an Athlete cancels, fees and refund eligibility may depend on when the cancellation occurs and whether the Creator has already reserved time, performed work, traveled, or delivered content.
9.3 Creator Cancellations
If a Creator cancels, the Athlete may receive a refund, and the Creator may lose payout eligibility for that Booking.
9.4 No-Shows and Delays
If either party is late, unavailable, unreachable, or otherwise prevents the Booking from being completed, Vizu may determine the appropriate outcome in its sole discretion based on the available information.
9.5 Force Majeure
Neither Vizu nor either user will be liable for delays or failure caused by events beyond reasonable control, including weather, venue restrictions, emergencies, travel disruptions, technical failures, or government action. Vizu may still decide how the Booking should be handled on the platform.
- User Content and Deliverables
10.1 Your Content
You are responsible for the Content You post, upload, send, store, or deliver through the Service.
You represent and warrant that You have the necessary rights to use and share that Content, and that doing so does not violate any law or third-party rights.
10.2 License to Vizu
By posting or uploading Content to the Service, You grant Vizu a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, distribute, and otherwise use such Content as needed to operate, improve, market, and provide the Service.
This includes, unless You and We agree otherwise in writing, the right to use profile photos, portfolio samples, reviews, usernames, listing content, and other marketplace-facing materials for marketplace operation and promotion.
10.3 Deliverables Ownership
Unless otherwise agreed between the Athlete and Creator in writing, Vizu does not determine who owns final deliverables, raw files, usage rights, or commercial rights.
Creators and Athletes are solely responsible for agreeing on: • ownership of final creative work, • whether raw files are included, • usage rights, • exclusivity, • posting rights, • portfolio rights, • and any license restrictions.
10.4 Portfolio and Promotional Use
Unless otherwise agreed in writing between the parties, Creators may not assume they have the right to use deliverables for portfolio, promotional, or commercial purposes beyond what is permitted by law or the agreement between the parties.
Athletes and Creators are responsible for addressing these rights clearly before or during the Booking.
- Prohibited Conduct
You may not use the Service to: • violate any law or regulation; • commit fraud, deception, chargeback abuse, or payment abuse; • impersonate any person or entity; • upload unlawful, defamatory, obscene, threatening, hateful, or infringing Content; • interfere with or disrupt the Service; • attempt to bypass marketplace fees or payment flows in violation of platform rules; • scrape, copy, or exploit marketplace data without permission; • upload malware, viruses, or harmful code; • harass, threaten, or abuse another user.
We may investigate and take action against any prohibited conduct, including warning, suspension, cancellation of Bookings, payout holds, content removal, or account termination.
- Identity, Safety, and Platform Trust
Vizu may use identity verification, review systems, account approval, moderation, and other trust and safety measures.
However, Vizu does not guarantee that any user is truthful, safe, qualified, insured, licensed, available, or suitable for any particular purpose.
Users are responsible for using good judgment and conducting any additional checks they believe are necessary.
- Intellectual Property Complaints
If You believe Content on the Service infringes Your copyright or other intellectual property rights, contact Us at legal@vizuconnect.com with enough detail for Us to investigate.
We may remove or disable access to allegedly infringing Content at Our discretion.
- Third-Party Services
The Service may rely on third-party services, including payment processors, verification providers, communication tools, file storage tools, analytics providers, and other external platforms.
We are not responsible for the availability, security, functionality, or policies of third-party services.
- Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, Vizu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not guarantee: • that the Service will always be available or error-free; • that any user will fulfill their obligations; • that any Booking will result in a desired business, athletic, or creative outcome; • that any content will be backed up or preserved indefinitely; • or that payment providers or other third parties will function without interruption.
- Limitation of Liability
To the fullest extent permitted by law, Vizu and its affiliates, owners, officers, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, reputational harm, lost business opportunities, or personal injury arising from or related to the Service, a Booking, user conduct, or third-party services.
To the fullest extent permitted by law, Vizu’s total liability for any claim arising out of or relating to the Service will not exceed the greater of: • the total amount You paid to Vizu through the Service in the 12 months before the event giving rise to the claim, or • USD $100.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
- Indemnification
You agree to defend, indemnify, and hold harmless Vizu and its affiliates, owners, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: • Your use of the Service; • Your Content; • Your violation of these Terms; • Your Booking, services, deliverables, or disputes with another user; • or Your violation of any law or third-party rights.
- Disputes Between Users
Users are responsible for resolving disputes with one another.
Vizu may, but is not obligated to, assist with disputes, review evidence, pause payouts, issue refunds, remove content, or take other action. Any such action is at Vizu’s sole discretion and does not create any duty to do so in any particular case.
- Governing Law
These Terms are governed by the laws of the State of Texas and the United States, without regard to conflict of laws principles.
If You are a consumer in a jurisdiction that grants You non-waivable legal rights, those rights remain in effect to the extent required by law.
- Severability and Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
A failure by Vizu to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Changes to These Terms
We may update these Terms from time to time.
If We make material changes, We may provide notice through the Service, by email, or by other reasonable means. Continued use of the Service after the updated Terms take effect means You accept the revised Terms.
- Entire Agreement
These Terms, together with the Privacy Policy and any other policies or rules expressly incorporated by reference, form the entire agreement between You and Vizu regarding the Service.
